Terms of Service
Effective date: April 6, 2026
1. Agreement to Terms
By accessing or using social-claw ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 15 days before they take effect. Continued use after the effective date of any update constitutes acceptance.
2. Description of Service
social-claw provides social media management tools including post scheduling, automated direct messaging, and analytics for platforms such as Instagram, Facebook, TikTok, and YouTube ("Connected Platforms"). The Service acts on your behalf through authorized connections to third-party platform APIs.
3. Eligibility & Account Registration
You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
4. Connected Accounts & Authorizations
To use the Service, you grant social-claw permission to access and interact with your social media accounts via their official APIs. By connecting an account you represent and warrant that:
- You are the authorized owner or administrator of the social media account
- You have the authority to grant API access to social-claw
- Your use of the Service complies with each Connected Platform's terms of service, community guidelines, and developer policies
You may revoke access at any time through the Connected Platform's settings or your social-claw dashboard. Revoking access may disable features that depend on that connection.
5. Platform Compliance
You are solely responsible for ensuring that your use of the Service complies with the terms, policies, and guidelines of each Connected Platform, including but not limited to:
- Meta Platform Terms and Instagram Platform Policy (including messaging window restrictions and automation policies)
- TikTok Terms of Service and Developer Policy
- YouTube Terms of Service and Google API Services User Data Policy
social-claw does not guarantee that the Service will always be compatible with every Connected Platform's current policies. Platforms may change their rules at any time. It is your responsibility to stay informed of platform policy changes that affect your use.
6. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk messages, spam, or harassing content
- Violate any applicable law or the terms of service of any Connected Platform
- Distribute malware, phishing links, or deceptive content
- Impersonate another person or entity
- Artificially inflate engagement metrics (followers, likes, comments) using bots or fraudulent means
- Attempt to gain unauthorized access to the Service or its infrastructure
- Scrape, reverse-engineer, or interfere with the operation of the Service
- Use the Service in any way that could damage, disable, or impair the Service or interfere with other users
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
7. Automated Messaging & Anti-Spam
The Service includes automated direct messaging features triggered by user-defined rules (e.g., keyword responses, follow gates). By using these features you acknowledge and agree that:
- You are solely responsible for the content, frequency, and targeting of all automated messages sent through your account
- You must comply with all applicable anti-spam laws, including the Information Technology Act, 2000 (India), CAN-SPAM Act (US), and any other laws applicable in your jurisdiction
- You must respect platform-enforced messaging windows. For example, Meta limits automated replies to a 24-hour window after a user's last interaction, after which only manual messages are permitted for up to 7 days
- You must not use automated messaging to send promotional content to users who have not initiated a conversation or opted in
- You must provide recipients with a clear way to opt out of further automated messages
social-claw monitors for abusive messaging patterns and reserves the right to throttle, disable, or terminate accounts that engage in spammy behaviour, regardless of whether a Connected Platform has taken action.
8. Content Ownership
You retain ownership of all content you create, upload, or schedule through the Service. By using the Service, you grant social-claw a limited, non-exclusive, worldwide, royalty-free license to store, process, and transmit your content solely for the purpose of providing the Service. This license ends when you delete the content or your account.
You represent and warrant that you own or have the necessary rights to all content you submit, and that it does not infringe on any third party's intellectual property or other rights.
9. Content Persistence on Platforms
Deleting content from social-claw (including cancelling scheduled posts or removing DM rules) does not delete content that has already been published or sent on a Connected Platform. Once content is delivered to a platform, it is governed by that platform's retention and deletion policies. You must manage published content directly on the platform if you wish to remove it.
10. Subscriptions & Payments
Paid plans are billed in advance on a recurring basis and automatically renew at the end of each billing period. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice. The new price applies on your next renewal. Refunds are provided at our sole discretion.
11. Third-Party Services & API Risk
The Service relies on APIs and integrations provided by Connected Platforms (Instagram, Facebook, TikTok, YouTube, and others). You acknowledge and agree that:
- We are not responsible for the availability, accuracy, or policies of Connected Platforms
- Connected Platforms may change, rate-limit, restrict, or discontinue their APIs at any time without notice to us
- Such changes may degrade or disable features of the Service, and we are not liable for any resulting disruption, failed deliveries, or loss of functionality
- We do not guarantee that content will be delivered, published, or displayed correctly on any Connected Platform
12. Indemnification
You agree to indemnify, defend, and hold harmless social-claw and its operators, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) content you create, schedule, or send through the Service; (c) your violation of these Terms; (d) your violation of any Connected Platform's terms or policies; or (e) your violation of any applicable law.
13. Limitation of Liability
To the maximum extent permitted by law, social-claw and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content will be delivered or published successfully on any Connected Platform.
15. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, abusive messaging behaviour, or for any other reason with reasonable notice. You may terminate your account at any time from your dashboard settings.
Upon termination: (a) your right to use the Service ceases immediately; (b) you lose access to scheduled posts, DM rules, and analytics data. We recommend exporting your data before cancelling; (c) we will delete your personal data in accordance with our Privacy Policy; (d) content already published on Connected Platforms is not affected and remains on those platforms.
16. Intellectual Property
The Service, including its design, code, logos, and documentation, is owned by social-claw and protected by applicable intellectual property laws. These Terms do not grant you any right to use social-claw's trademarks, logos, or branding without prior written consent.
17. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at the email below. We will attempt to resolve the dispute within 30 days.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
